If you do not agree with any part of these Terms, you should refrain from using our website or services.
• Eligibility: Our services, including ticket purchases and event participation, are available to individuals who are at least 21 years old. By using our services, you confirm that you meet this age requirement and that you have the legal capacity to enter into binding agreements.

3. Event Ticketing
• Ticket Purchase Process:
Tickets for our events can be purchased exclusively through our website www.ecomfounders.com or through authorized third-party ticketing platforms. You will receive an email confirmation or SMS message with your ticket details once your purchase is completed. Please ensure that all information provided during the purchase process is accurate, as we are not responsible for errors made by the purchaser.
• Ticket Refund Policy: All ticket sales are non-refundable, except in the following cases: event cancellation or significant change in event details. Requests for refunds must be submitted within 7 of the event date. Refunds will be processed within 14 after the request is approved, using the original payment method. We reserve the right to refuse refund requests that do not meet the criteria outlined in these Terms.
• Ticket Transferability: Tickets are non-transferrable with the exception to others who work at the same company as you do. Ticket transfers can only be completed by written confirmation from Ecom Founders, LLC.
• Lost or Stolen Tickets: We are not responsible for lost, stolen, or damaged tickets. If your ticket is lost or stolen, please contact our customer service at info@ecomfounders.com as soon as possible. Depending on the circumstances, we may be able to reissue your ticket, but this is not guaranteed.
• Event Cancellation or Postponement: In the event that an event is canceled or postponed due to unforeseen circumstances, including but not limited to, weather conditions, performer illness, or government restrictions. We will notify you via email or SMS message. If an event is canceled, you may be offered a refund, partial refund, credit to a future event, but this is at the sole discretion of Ecom Founders, LLC.
• VIP and Special Access Tickets: If you purchase VIP or special access tickets, please be aware that these tickets may include additional terms and conditions specific to the benefits provided, such as early entry, exclusive merchandise, or meet-and-greet opportunities. Details will be provided at the time of purchase, and you must comply with any additional rules associated with VIP or special access privileges.

4. Payment TermsPayment Security: We are committed to ensuring that your payment information is secure. All payments are processed through Stripe which employs industry-standard encryption technology to protect your data. We do not store your payment details on our servers.
•Additional Fees: The total cost of your ticket or service may include additional fees such as booking fees, service charges, taxes, etc. These fees will be clearly displayed during the checkout process. By completing your purchase, you agree to pay the full amount, including all applicable fees. Any fees required to attend the event such as travel will not be covered or refunded by Ecom Founders, LLC.
• Payment Deadlines: Full payment is required immediately upon purchase or before a specified deadline for any event
• Failed Payments: In the event that your payment is declined or fails for any reason, you will be notified immediately, and we will attempt to process the payment again. If the payment cannot be processed, your order may be canceled, and you may lose your ticket reservation. You will be required to provide an alternative payment method to complete the purchase.
• Payment Disputes: If you believe that a payment was processed in error or unauthorized, you must notify us immediately at info@ecomfounders.com We will investigate the issue and, if appropriate, provide a refund or take corrective action. Please be aware that initiating a chargeback through your bank or credit card provider without first contacting us may result in the loss of your ticket and may be considered a breach of these Terms.

5. User Conduct
• Prohibited Behaviors:
To ensure a safe and enjoyable experience for all attendees, inappropriate behaviors are strictly prohibited at our events, such as, but not limited to, verbal or physical harassment, violence, intoxication, disorderly conduct, use of illegal substances, possession of weapons, etc. Any attendee engaging in these behaviors will be subject to removal from the event without a refund, potentially litigated, and may be banned from future events.
• Code of Conduct: Attendees are expected to behave respectfully towards others, including event staff, performers, and fellow attendees. Violations may result in warnings, removal from the event, or other disciplinary actions as deemed appropriate by event organizers.
• Liability for Damage: You are responsible for any damage you cause to the venue, equipment, or property of others. If you damage property, you may be held financially liable for the cost of repair or replacement. We reserve the right to seek reimbursement through legal means if necessary.
• Health and Safety: Attendees are required to comply with all health and safety regulations in place at the event venue. Failure to comply with health and safety regulations may result in removal from the event without a refund.
• Photography and Recording: Photography, video recording, and audio recording are permitted at our events. If permitted, the recording must not interfere with the enjoyment of other attendees or the performance. Unauthorized professional photography or recording may result in the confiscation of equipment and removal from the event.

Sponsoring companies may get details submitted for attendance of physical and digital events hosted.

9. Cancellations and Rescheduling
• Event Cancellation by Us:
If we cancel an event due to circumstances beyond our control, including but not limited to, acts of God, natural disasters, pandemics, government regulations, we will notify you via emai or phone number. In such cases, you may be offered a full refund, credit for a future event, or the option to transfer your ticket to a rescheduled date, at the sole discretion of Ecom Founders, LLC. Refunds will be processed within 14 days of the cancellation notice.
• Cancellation by Attendees: If you need to cancel your attendance, you must notify us at least 14 before the event. Refunds are at the discretion of Ecom Founders, LLC].
• Force Majeure: In the event of a force majeure, such as, but not limited to, war, terrorist attacks, labor strikes, pandemics, ec, that makes it impossible or impractical to hold the event, we reserve the right to cancel or reschedule the event. In such cases, we will provide you with options for refunds, credits, or rescheduling, depending on the circumstances.
• Event Rescheduling: If an event is rescheduled, your ticket will automatically be valid for the new date. If you are unable to attend the rescheduled event, you may request a refund within 14 of the rescheduling announcement. Refunds will be processed according to our standard refund policy.

10. Third-Party Services
• Use of Third-Party Vendors:
We partner with third-party vendors and service providers to enhance your event experience, including but not limited to, ticketing platforms, catering services, security personnel, merchandise vendors, etc. While we strive to work with reputable vendors, we are not responsible for the actions, errors, or omissions of these third parties.
• Vendor Liability: Any issues, disputes, or claims related to third-party services should be addressed directly with the vendor. We may assist in facilitating communication, but we do not assume liability for any third-party services. If a vendor fails to deliver services as expected, we are not liable and indemnified from anything that comes from this.

Termination by you does not relieve you of any obligations or liabilities that accrued prior to termination. Any outstanding payments or obligations must be fulfilled, even after termination.
• Survival of Provisions: Upon termination of these Terms, any provisions that by their nature should survive termination (such as intellectual property rights, indemnification obligations, limitations of liability, and governing law) will continue to be in effect.

• Waiver of Class Action: You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. All disputes must be resolved on an individual basis, and you may only bring claims on your own behalf.
• Costs of Arbitration: Each party will bear its own costs and expenses associated with the arbitration, including legal fees, unless the arbitrator determines that such costs should be otherwise allocated in accordance with applicable law. The costs of the arbitration itself, including the arbitrator's fees, will be shared equally by the parties, unless otherwise determined by the arbitrator.

• Force Majeure: We are not liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor strikes, government actions, pandemics, or other unforeseen events. If a force majeure event occurs, we will notify you as soon as possible and take reasonable steps to mitigate the impact on our services.
• Notices: Any notices or communications required or permitted under these Terms must be in writing and delivered to Ecom Founders, LLC at 7 Boulden Circle, New Castle DE 19720 or by email to info@ecomfounders.com. Notices to you will be sent to the email address or physical address you provided when you registered for our services, or as otherwise updated in your account information.

20. Indemnification and Liability for Physical Events
• Indemnification by Attendees:
You agree to indemnify, defend, and hold harmless Ecom Founders, LLC, its affiliates, officers, directors, employees, agents, contractors, vendors, and representatives (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees and court costs) that may arise out of or relate to your attendance at or participation in any physical events organized, hosted, or facilitated by Ecom Founders, LLC. This includes, but is not limited to, claims arising from:

Personal injury, illness, or death, whether caused by negligence, intentional acts, or otherwise.
Property damage or loss, including theft, vandalism, or destruction of personal property.
Any act or omission by you or any third party while attending or participating in the event.
Violations of any applicable laws, regulations, or ordinances by you or any third party in connection with the event.
Any breach of these Terms and Conditions or any other agreements between you and Ecom Founders, LLC.
• Assumption of Risk: By attending any physical event organized by Ecom Founders, LLC, you acknowledge and agree that you are voluntarily assuming all risks associated with the event, including but not limited to, risks of physical injury, illness (including but not limited to communicable diseases such as COVID-19), death, property damage, and any other harm that may arise. You understand and agree that the Indemnified Parties cannot and do not guarantee your safety or security at these events.
• Waiver of Claims: To the fullest extent permitted by law, you hereby waive any and all claims, actions, or causes of action of any kind that you may have against the Indemnified Parties arising out of or in connection with your attendance at or participation in any physical event, including but not limited to claims for negligence, gross negligence, strict liability, breach of warranty, or any other legal theory. This waiver applies whether the claims are known or unknown, foreseen or unforeseen, and whether they arise from your own actions or those of third parties.
• No Liability for Third-Party Actions: Ecom Founders, LLC is not responsible or liable for the actions, conduct, or omissions of any third parties, including but not limited to other attendees, vendors, contractors, venue operators, security personnel, or any other individuals or entities involved in the event. Any disputes or issues that arise with third parties are solely between you and the third party, and you agree to hold the Indemnified Parties harmless from any liability related to such disputes.
• No Representations or Warranties: Ecom Founders, LLC makes no representations or warranties, express or implied, regarding the safety, security, or suitability of the event venue, the conduct of other attendees, or any other aspect of the physical event. You are responsible for your own safety and well-being while attending the event, and you are encouraged to take all necessary precautions to protect yourself and your property.
• Insurance: You are solely responsible for obtaining and maintaining any personal insurance coverage that may be necessary or appropriate for your participation in the event, including but not limited to health insurance, travel insurance, and property insurance. Ecom Founders, LLC does not provide any insurance coverage for attendees and is not responsible for any costs or losses that may result from your failure to obtain adequate insurance.
Limitation of Liability: In no event shall the Indemnified Parties be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to, lost profits, loss of use, loss of data, or any other intangible losses arising out of or in connection with your attendance at or participation in any physical event, even if Ecom Founders, LLC has been advised of the possibility of such damages. The total liability of the Indemnified Parties to you for any and all claims arising out of or in connection with your attendance at or participation in any physical event shall be limited to the amount you paid for your ticket or registration to the event, if any.
• Binding Effect: This indemnification and liability clause shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, executors, administrators, successors, and assigns. You acknowledge and agree that this clause is a material inducement for Ecom Founders, LLC to allow you to attend and participate in the event, and that Ecom Founders, LLC would not permit your attendance or participation without your agreement to the terms set forth herein.
